Question 1

A contractor must designate a competent person, as the term is defined in 29 CFR 1926.32, to oversee daily site conditions. Four people are under consideration. Which one meets the definition?

Show answer and source

Answer: C. A foreman who can recognize existing and predictable hazards on the site and has been given authority by the employer to stop work and order immediate repairs

The foreman has both elements the standard requires: the capability to identify existing and predictable hazards and the authorization to take prompt corrective measures. The consultant can spot hazards but cannot correct them. The signaling laborer is only an authorized person, someone assigned to a specific duty or location, which is a different term. The project manager has the authority but cannot identify hazards.

Answer C rests on

29 CFR 1926.32(f)(opens ecfr.gov in a new tab)
“Competent person means one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them.”

Question 2

A utility contractor is sending a crew to clear brush and dig trenches along a rural right-of-way. During the site walk, the competent person finds a large, active nest of venomous snakes and a dense patch of poison ivy along the planned work path. Crew members have never worked in this type of terrain. Which action does the standard require of the employer before these employees work in that area?

Show answer and source

Answer: B. Instruct the exposed employees about the potential hazards, how to avoid injury, and the first aid procedures to use if injury occurs

Where harmful plants or animals are present, the standard requires instructing exposed employees on the hazards, how to avoid injury, and first aid. Merely using the Secretary's programs is stated as something the employer 'should' do, not a substitute for the employer's duty. The substance-handling and flammable/toxic material provisions apply to different exposures that are not the issue here.

Answer B rests on

29 CFR 1926.21(b)(4)(opens ecfr.gov in a new tab)
“(4) In job site areas where harmful plants or animals are present, employees who may be exposed shall be instructed regarding the potential hazards, and how to avoid injury, and the first aid procedures to be used in the event of injury.”

Question 3

A subcontractor on a construction project covered by the Act engages a worker through a written agreement that labels him an "independent contractor" responsible for his own taxes and not on the payroll. Every shift he hauls and places materials by hand and uses hand tools on the subcontractor's work. When the subcontractor decides whose safety is covered, how should this worker be treated under the definitions?

Show answer and source

Answer: D. As an employee, because the contract label does not change the fact that he is a laborer or mechanic working for the subcontractor

The definition of employee covers every laborer or mechanic regardless of the contractual relationship alleged between the worker and the subcontractor who engaged him. The independent-contractor label and payroll status therefore do not decide the question, and the standard sets no wage-contract condition.

Answer D rests on

29 CFR 1926.32(j)(opens ecfr.gov in a new tab)
“Employee means every laborer or mechanic under the Act regardless of the contractual relationship which may be alleged to exist between the laborer and mechanic and the contractor or subcontractor who engaged him.”
