An employer receives an OSHA citation for an unguarded floor opening at its single warehouse. The citation is posted Monday morning near the opening. The employer immediately installs a cover, fully abating the hazard by Monday noon, and also files a notice of intention to contest the citation. The safety manager asks when the posted citation may be removed. Which response is correct under the posting rule?
Show answer and source
Answer: D. It must remain posted for 3 working days, since that is later than the time to abate; the contest filing does not end the posting duty.
The citation stays posted until abatement or 3 working days, whichever is later; here abatement took hours, so the 3 working days control. Filing a contest does not change the posting duty unless the Review Commission issues a final order vacating the citation, so removing it upon filing is wrong.
“Each citation, or a copy thereof, shall remain posted until the violation has been abated, or for 3 working days, whichever is later. The filing by the employer of a notice of intention to contest under § 1903.17 shall not affect his posting responsibility under this section unless and until the Review Commission issues a final order vacating the citation.”
During an inspection of a fabrication plant, a Compliance Safety and Health Officer (CSHO) observes an unguarded machine hazard and tells the supervisor, who immediately installs a guard before the CSHO leaves the site. The CSHO's report to the Area Director documents the violation and the correction. The inspection ended four weeks ago, and the safety manager is now asked whether the employer can expect a citation. Based on the standard, what is the most accurate answer?
Show answer and source
Answer: D. A citation can still be issued, because immediate abatement after being informed of the violation does not prevent an appropriate citation.
The standard says an appropriate citation or de minimis notice must be issued even if the employer immediately abates or begins abatement after the CSHO identifies the violation. The citation is also timely, since it must follow the inspection with reasonable promptness and within 6 months of the violation. A de minimis notice is reserved for violations with no direct or immediate relationship to safety or health, so correction alone does not convert an unguarded machine hazard into one.
“An appropriate citation or notice of de minimis violations shall be issued even though after being informed of an alleged violation by the Compliance Safety and Health Officer, the employer immediately abates, or initiates steps to abate, such alleged violation.”
