Question 1
A remediation contractor hires an experienced hazardous waste worker who holds a certificate from a prior employer showing training equivalent to the initial HAZWOPER training. The worker is new to the contractor's clean-up site and is scheduled to enter the exclusion zone on his first morning. The site manager believes the certificate alone is enough, so no further site training is needed. Which action is required?
Show answer and source
Answer: C. Give the worker appropriate site-specific training before site entry and supervised field experience at the new site
Equivalent training excuses the employer from the initial training, but a certified worker new to a site still needs appropriate site-specific training before entry and supervised field experience there. The certificate does not waive everything, and the employer need not repeat the full initial course.
Answer C rests on
29 CFR 1926.65(e)(9)(opens ecfr.gov in a new tab)“However, certified employees or employees with equivalent training new to a site shall receive appropriate, site specific training before site entry and have appropriate supervised field experience at the new site.”
Question 2
A contractor is starting cleanup of a site contaminated with hazardous substances. A new general laborer will be removing contaminated soil. The site supervisor proposes sending the laborer to work immediately alongside experienced workers and arranging classroom training "sometime during the first month." Based on the HAZWOPER training rule, what is the correct response?
Show answer and source
Answer: C. Not acceptable, because employees may not take part in field activities until trained to the level their job function requires.
The standard bars employees from participating in or supervising field activities until they are trained to the level their job requires. Delayed training and on-the-job pairing do not meet this requirement, and general laborers are explicitly covered.
Answer C rests on
29 CFR 1926.65(e)(1)(ii)(opens ecfr.gov in a new tab)“(ii) Employees shall not be permitted to participate in or supervise field activities until they have been trained to a level required by their job function and responsibility.”
Question 3
A land surveyor employed by a subcontractor will spend two days on a hazardous waste cleanup site staking boundary points. Site characterization shows she is unlikely to be exposed above permissible or published exposure limits, and she will not return after the task is finished. She has completed 24 hours of off-site HAZWOPER instruction. What else must she receive before working on site?
Show answer and source
Answer: D. A minimum of one day of actual field experience under the direct supervision of a trained, experienced supervisor
A worker on site only occasionally for a limited task such as land surveying and unlikely to be overexposed needs 24 hours of off-site instruction plus one day of field experience under direct supervision. The 16 additional hours and two days apply only if she becomes a general site worker or must wear a respirator.
Answer D rests on
29 CFR 1926.65(e)(3)(ii)(opens ecfr.gov in a new tab)“Workers on site only occasionally for a specific limited task (such as, but not limited to, ground water monitoring, land surveying, or geo-physical surveying) and who are unlikely to be exposed over permissible exposure limits and published exposure limits shall receive a minimum of 24 hours of instruction off the site, and the minimum of one day actual field experience under the direct supervision of a trained, experienced supervisor.”
