Question 1
A contractor hires a crane operator who holds a college degree in construction engineering and a certificate from a crane safety course. The site superintendent wants to put the operator on a lattice boom crawler crane right away, without any employer evaluation, because of these credentials. What does the standard say about this approach?
Show answer and source
Answer: D. It is not acceptable, because possession of a certificate or degree cannot, by itself, cause a person to be qualified for the employer's evaluation requirement
The standard states that the § 1926.32 definition of "qualified" does not apply and that a certificate or degree alone cannot qualify a person. The employer must still evaluate the operator. A recent certificate or a self-declaration does not change this.
Answer D rests on
29 CFR 1926.1427(f)(3)(opens ecfr.gov in a new tab)“The definition of “qualified” in § 1926.32 does not apply to paragraph (f)(1) of this section: Possession of a certificate or degree cannot, by itself, cause a person to be qualified for purposes of paragraph (f)(1).”
Question 2
Six months after ladder and stairway training, a safety technician notices that several crew members are setting up ladders incorrectly and have forgotten key hazard recognition points. What does the standard require the employer to do?
Show answer and source
Answer: D. Provide retraining as necessary so employees maintain the understanding and knowledge acquired
Retraining must be provided as necessary so employees maintain their understanding and knowledge. The standard ties retraining to need, not to a fixed annual date or to an injury occurring, and changing equipment does not remove the duty.
Answer D rests on
29 CFR 1926.1060(b)(opens ecfr.gov in a new tab)“Retraining shall be provided for each employee as necessary so that the employee maintains the understanding and knowledge acquired through compliance with this section.”
Question 3
A utility contractor sends crews to several different job locations each shift. The employer keeps all safety data sheets (SDSs) in the binder at the main yard office. A crew leader asks what the employer must still ensure for crews working away from the yard. Which response is correct?
Show answer and source
Answer: A. Employees must be able to immediately obtain the required information in an emergency
When employees travel between workplaces during a shift, the SDSs may be kept at the primary facility, but the employer must ensure employees can immediately obtain the information in an emergency. A delay of a business day is not immediate, and the standard does not require paper copies at every location.
Answer A rests on
29 CFR 1910.1200(g)(9)(opens ecfr.gov in a new tab)“Where employees must travel between workplaces during a workshift, i.e., their work is carried out at more than one geographical location, the safety data sheets may be kept at the primary workplace facility. In this situation, the employer shall ensure that employees can immediately obtain the required information in an emergency.”
