Question 1

A warehouse's emergency action plan has not been revised in two years. Today, a maintenance technician with no previous role in the plan is newly designated as an evacuation assistant for the mezzanine. The text of the plan is unchanged. The safety manager must decide what review the standard requires.

Show answer and source

Answer: A. Review the plan with that technician now, because the technician's responsibilities under the plan have changed.

The standard requires the employer to review the plan with each covered employee when that employee's responsibilities under the plan change, even if the plan text stays the same. The tempting option about waiting for an annual refresher fails because the standard ties the review to the change in responsibilities, not to a calendar date.

Answer A rests on

29 CFR 1910.38(f)(2)(opens ecfr.gov in a new tab)

Question 2

A plant names a shift supervisor as the on-scene incident commander who will take control of any release that goes beyond the first responder awareness level. The supervisor's file shows 16 hours of training equal to the first responder operations level. The employer has certified in writing that she is competent in every required incident commander competency area. What does the file still lack?

Show answer and source

Answer: B. Eight more hours of operations-level training, which brings the total to the required minimum of 24 hours

The standard sets a floor of at least 24 hours of training equal to the first responder operations level for incident commanders, and the competencies and employer certification are required in addition to those hours. Her 16 hours fall 8 short. The certification therefore cannot substitute for the hours, and the standard does not set a technician-level 40-hour requirement for this role.

Answer B rests on

29 CFR 1910.120(q)(6)(v)(opens ecfr.gov in a new tab)
“On scene incident commander. Incident commanders, who will assume control of the incident scene beyond the first responder awareness level, shall receive at least 24 hours of training equal to the first responder operations level and in addition have competency in the following areas and the employer shall so certify:”

Question 3

A chemical plant's emergency response team has a member who completed 24 hours of hazardous materials technician-level training and was certified competent in all technician areas. Management wants to designate this person as the team's hazardous materials specialist, who will identify unknown materials with advanced survey instruments and liaise with state and local agencies. Under the standard, what must be in place before the designation is valid?

Show answer and source

Answer: D. The employee must also show competency in the specialist areas, such as the local and state emergency response plans, advanced instrument use and specialized chemical PPE, and the employer must certify this

The standard requires at least 24 hours of training equal to the technician level plus competency in the specialist areas, and the employer must certify it. Technician training alone is not enough, and no additional hours or state certification is called for.

Answer D rests on

29 CFR 1910.120(q)(6)(iv)(opens ecfr.gov in a new tab)
“Hazardous materials specialists shall have received at least 24 hours of training equal to the technician level and in addition have competency in the following areas and the employer shall so certify:”
