Question 1

A chemical distributor revises its written hazmat security plan after adding a new rail-transfer operation. The revised plan is approved on March 1. On March 10, a dock supervisor, who is assigned security duties under the plan, is still working from a printed copy of the prior version, and the company's file contains only the new version. Which action does the standard require to bring the company into compliance?

Show answer and source

Answer: A. Notify all employees responsible for implementing the plan of the revision, and keep all copies of the plan maintained as of the date of the most recent revision

When a plan is updated or revised, the standard requires that all employees responsible for implementing it be notified and that all copies be maintained as of the date of the most recent revision. The supervisor has assigned security duties, so waiting for the annual review or limiting notification to management does not satisfy the requirement.

Answer A rests on

49 CFR 172.802(c)(opens ecfr.gov in a new tab)
“When the security plan is updated or revised, all employees responsible for implementing it must be notified and all copies of the plan must be maintained as of the date of the most recent revision.”

Question 2

A distribution center employee decants corrosive liquids into packages and prepares them for shipment. So far, the employee has completed a course on recognizing and identifying hazardous materials from labels, markings and shipping papers, and a session on the packaging and marking requirements for the exact packages he prepares. The employer has installed local exhaust ventilation at the decanting station and requires splash goggles, gloves and a specific eyewash procedure. Which required training element has NOT yet been provided?

Show answer and source

Answer: B. Safety training on protecting the employee from the hazards he may be exposed to at work, including the employer's specific exposure-protection measures

The hazard-recognition course is general awareness training, and the packaging and marking session is function-specific training. What is missing is safety training on workplace exposure hazards, including the ventilation, PPE and eyewash measures the employer has put in place. Repeating general awareness or training on unrelated functions would not supply this element, and the ICAO alternative applies only to function-specific training.

Answer B rests on

49 CFR 172.704(a)(3)(ii)(opens ecfr.gov in a new tab)
“(ii) Measures to protect the employee from the hazards associated with hazardous materials to which they may be exposed in the work place, including specific measures the hazmat employer has implemented to protect employees from exposure; and”
