Competent person

Someone who can recognize existing and predictable hazards and has the authority to correct them right away.

Definition, in the source's words

29 CFR 1926.32(f)(opens ecfr.gov in a new tab)
“Competent person means one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them.”

What it means

The definition has two parts, and a person needs both: the ability to identify hazards, and the authority to act on them promptly. Knowledge without authority doesn't qualify, and neither does authority without knowledge.

The definition names no certificate or course. It turns on what the person can do and whether the employer lets them act. Many construction standards assign duties to a competent person, such as daily excavation inspections in 1926.651(k).

Example

A foreman inspects a trench before the shift, sees water seeping in at the bottom, and has the authority to stop work and get the crew out. The foreman meets both parts. A laborer who sees the same water but can't stop work does not, however experienced.

Questions

What's the difference between a competent person and a qualified person?
A competent person can identify hazards and has authority to correct them promptly. A qualified person has a recognized degree, certificate or professional standing, or extensive knowledge, training and experience, and has shown they can solve problems in the subject. One person can be both.
Does OSHA certify competent persons?
No. The 1926.32(f) definition is about capability and authorization. The employer designates the person; some standards add specific training requirements.
