“(2) Additional requirement for shield systems used in trench excavations. Excavations of earth material to a level not greater than 2 feet (.61 m) below the bottom of a shield shall be permitted, but only if the shield is designed to resist the forces calculated for the full depth of the trench, and there are no indications while the trench is open of a possible loss of soil from behind or below the bottom of the shield.”
“(iii) At least one copy of the tabulated data which identifies the registered professional engineer who approved the data, shall be maintained at the jobsite during construction of the protective system. After that time the data may be stored off the jobsite, but a copy of the data shall be made available to the Secretary upon request.”
“(4) Option (4)—Design by a registered professional engineer. (i) Sloping and benching systems not utilizing Option (1) or Option (2) or Option (3) under paragraph (b) of this section shall be approved by a registered professional engineer.”
“(iii) At least one copy of the design shall be maintained at the jobsite while the slope is being constructed. After that time the design need not be at the jobsite, but a copy shall be made available to the Secretary upon request.”
“(ii) Deviation from the specifications, recommendations, and limitations issued or made by the manufacturer shall only be allowed after the manufacturer issues specific written approval.”

Question 1

A excavation contractor is sloping the sides of a trench using tabulated data that a registered professional engineer approved. The written tables list the soil parameters affecting selection and the maximum safe slopes, and they name the approving engineer. The competent person on site wants to check the trench slope against the tables, but the only copy is in the home-office files 40 miles away, where the project manager says it is available on request. Construction of the sloping system is underway. What is the correct assessment?

Show answer and source

Answer: C. Not compliant, because at least one copy of the data identifying the approving engineer must be kept at the jobsite while the protective system is being constructed

The standard requires at least one copy of the engineer-identified tabulated data at the jobsite during construction of the protective system, so a home-office copy does not comply. Off-site storage is allowed only after that construction period, which is why the tempting off-site option is wrong.

Question 2

A crew is installing aluminum hydraulic shoring in a 12-foot trench. After a dump truck backs into the stack of materials, the competent person finds one cylinder with a bent rod. She inspects it, but she cannot confirm that it can carry the loads it was designed for. The crew lead proposes: (1) pull the cylinder from the trench and set it aside, (2) put it back into service once the manufacturer's sales representative says it looks acceptable. Which action is required by the standard before that cylinder can be used in the trench again?

Show answer and source

Answer: D. Evaluation and approval by a registered professional engineer, since the competent person could not assure its suitability

Because the competent person cannot assure the damaged cylinder can support the intended loads, it must be removed from service and then evaluated and approved by a registered professional engineer before reuse. A sales representative's opinion or a repeat inspection by the competent person does not satisfy the standard, and neither does relocating the cylinder to a lighter-load area.

Answer D rests on

“If the competent person cannot assure the material or equipment is able to support the intended loads or is otherwise suitable for safe use, then such material or equipment shall be removed from service, and shall be evaluated and approved by a registered professional engineer before being returned to service.”

Question 3

A crew is installing a trench shield chosen from the manufacturer's tabulated data. On day two, the foreman finds that the trench will be deeper than the maximum depth in the manufacturer's data for that shield. The competent person has inspected the excavation and believes the shield can handle the extra depth. A supervisor suggests getting a verbal okay from the manufacturer's technical line and putting it in the daily log. Which action complies with the standard?

Show answer and source

Answer: C. Do not exceed the listed depth limit unless the manufacturer issues specific written approval, and keep that approval at the jobsite during construction of the protective system

A shield selected from manufacturer's tabulated data must be used within the manufacturer's limitations, and a deviation is allowed only with the manufacturer's specific written approval, which must be kept on the jobsite. A competent person's judgment or a verbal okay cannot replace that written approval.

Answer C rests on

“Deviation from the specifications, recommendations, and limitations issued or made by the manufacturer shall only be allowed after the manufacturer issues specific written approval.”
