A plant safety manager is reviewing the facility's hazard communication program. The plant purchases solvents from a supplier and does not manufacture or import any chemicals. The manager asks whether the plant must independently classify the hazards of each solvent. What is the correct answer?
Show answer and source
Answer: D. No; the plant is not required to classify unless it chooses not to rely on the manufacturer's or importer's classification
The standard places the classification duty on manufacturers and importers, and employers only need to classify if they choose not to rely on that classification. Requiring classification of every chemical by all employers is wrong, and employers are not barred from classifying.
“Employers are not required to classify chemicals unless they choose not to rely on the classification performed by the chemical manufacturer or importer for the chemical to satisfy this paragraph (d)(1).”
A retail store sells cleaning chemicals that employees handle only in sealed containers. A shipment of sealed containers arrives without a safety data sheet (SDS), and a stock clerk asks to see the SDS for one product. According to the hazard communication standard, what is the employer's obligation?
Show answer and source
Answer: C. Obtain an SDS as soon as possible because an employee requested it
For sealed containers received without an SDS, the employer must obtain one as soon as possible if an employee requests it. The sealed-container status does not eliminate that duty, and it is not limited to inspections or spills.
“shall obtain a safety data sheet as soon as possible for sealed containers of hazardous chemicals received without a safety data sheet if an employee requests the safety data sheet”
