Question 1

A chemical manufacturer shipped a hazardous solvent to a distributor last year and included the safety data sheet (SDS) with that initial shipment. Last month the manufacturer revised the SDS after it learned of significant new hazard information. The distributor has now placed a new order for the same solvent, and no one has asked for the updated SDS. What must the manufacturer do?

Show answer and source

Answer: D. Provide the revised SDS with this next shipment, because it is the first shipment after the SDS was updated

The standard requires the manufacturer to give distributors and employers an appropriate SDS with the first shipment after the SDS is updated. The earlier SDS does not satisfy this, and the manufacturer cannot wait for a request. A request is a separate trigger that applies in addition to this duty.

Answer D rests on

29 CFR 1910.1200(g)(6)(i)(opens ecfr.gov in a new tab)
“(6)(i) Chemical manufacturers or importers shall ensure that distributors and employers are provided an appropriate safety data sheet with their initial shipment, and with the first shipment after a safety data sheet is updated;”

Question 2

A chemical manufacturer has been supplying a solvent to a distributor for two years. On May 1 the manufacturer revises the solvent's safety data sheet after learning of significant new hazard information. The distributor's orders ship on April 20, May 15, and June 10. The manufacturer has not been asked for a copy of the revised SDS. Under the manufacturer's duty to provide updated SDSs to distributors, with which shipment must the revised SDS first be provided?

Show answer and source

Answer: C. The May 15 shipment, because it is the first shipment after the SDS was updated

The standard requires the manufacturer to provide the SDS with the first shipment after the SDS is updated. That is the May 15 shipment, regardless of any request. The April 20 shipment went out before the update. Waiting for a request or for a later shipment would miss the stated trigger.

Answer C rests on

29 CFR 1910.1200(g)(6)(i)(opens ecfr.gov in a new tab)
“(6)(i) Chemical manufacturers or importers shall ensure that distributors and employers are provided an appropriate safety data sheet with their initial shipment, and with the first shipment after a safety data sheet is updated;”

Question 3

A manufacturer sent a solvent to a customer in January, and the shipment came with the SDS. In March, the manufacturer learned of significant new hazard information and revised the SDS. In April, the same customer places a routine reorder for the same solvent. What must the manufacturer do for the April shipment?

Show answer and source

Answer: B. Provide the revised SDS with the shipment or send it before or at the time of shipment, because it is the first shipment after the update

The April order is the first shipment after the SDS was updated, so the customer must be given the revised SDS with the containers or before or at the time of shipment. Relying on the January SDS is wrong because the standard requires an SDS with the first shipment after an update, not only with the initial shipment.

Answer B rests on

29 CFR 1910.1200(g)(6)(i)(opens ecfr.gov in a new tab)
“(6)(i) Chemical manufacturers or importers shall ensure that distributors and employers are provided an appropriate safety data sheet with their initial shipment, and with the first shipment after a safety data sheet is updated;”
