Question 1
A fabrication shop has used the same solvent-based cleaners for years, and all employees were trained on them at hire. The purchasing manager switches to a new cleaner that contains a chemical with a hazard (carcinogenicity) the employees have never been trained about. What does the hazard communication standard require?
Show answer and source
Answer: D. Training on the new hazard is required when the new chemical hazard is introduced into the work area, because the employees have not previously been trained about it
The standard requires training whenever a new chemical hazard the employees have not previously been trained about is introduced into their work area. SDSs must always be available, but they do not replace the training, and the standard sets no annual-refresher timing for this trigger.
Answer D rests on
29 CFR 1910.1200(h)(1)(opens ecfr.gov in a new tab)“Employers shall provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new chemical hazard the employees have not previously been trained about is introduced into their work area.”
Question 2
A warehouse hires a forklift operator who holds a training record from a previous employer. The record covers the required training topics for sit-down counterbalanced trucks, which is the same type of truck the new employer uses. The new site's working conditions are similar to those at the old one. The new employer observes the operator on the job and evaluates him as competent to operate the truck safely. What does the standard require regarding training in those previously covered topics?
Show answer and source
Answer: A. No additional training in those topics is required, because the prior training fits the truck and conditions and the operator was evaluated and found competent
The prior training is appropriate to the truck and working conditions, and the operator was evaluated and found competent, so the standard says additional training in those topics is not required. Requiring a full repeat or a classroom repeat ignores this provision on avoiding duplicative training.
Answer A rests on
29 CFR 1910.178(l)(5)(opens ecfr.gov in a new tab)“If an operator has previously received training in a topic specified in paragraph (l)(3) of this section, and such training is appropriate to the truck and working conditions encountered, additional training in that topic is not required if the operator has been evaluated and found competent to operate the truck safely.”
